Everybody will be impacted by death during their lives and ultimately, we must all come to the same conclusion. When someone dies it is hard enough to deal with the emotional aspects of grief, without the added complications of sorting the legal and financial affairs. Most people assume that it will be simple and everything will be straightforward especially if they are married. Quite often though the person expected to deal with the estate is the person that is least likely to be in a position to think clearly and understand the importance of the documentation to be completed due to the emotional and practical upheaval of losing a loved one.
Dealing with the effects and ramifications of losing a close relative or friend can add significant stress to anyone. You may be required to deal with their estate which can be anything from arranging their funeral, closing a bank account or selling their property. You may also be needed to support and care for your remaining relatives or friends. You will need time to grieve and we can assist by guiding you through the process as far as possible.
Whether or not your departed friend or relative had a Will determines how you must deal with the estate and the responsibilities of an Executor and Administrator are many. You will be responsible for assessing all the estate including the assets and debts. You will need to report to the Tax office and decipher whether inheritance tax is payable (which must be paid before assets are collected). You will need to apply for a Grant of Probate or Letters of Administration through the courts and contact all asset holders completing and submitting their requisite closure/transfer forms. The property will need to be sold or transferred to the beneficiaries and if it was rented it will need to be cleared and all rent paid up to date. Once all the administrative formalities have been completed then you will need to finalise the estate by preparing the Estate Accounts and having them approved by all the beneficiaries. The whole process can take anything from 6 months to 5 years to undertake and many find it a very daunting task.
